MAY 2, 1999 HUNGER STRIKE DAY 98/91; 2nd CHANCE


Today it seems appropriate to address a few events which can easily be attributed to a power beyond that of a mere mortal.

The decision which placed me on a collision course with the establishment, "those who are in control" was made in 1962. Although not literally one, it was in the nature of a new years resolution. Like virtually all such resolutions, as time passed, I strayed from it. It seemed that each time I would do so, the big guy, yes, the guy of infinite love, the all loving guy had a very sharp stick which had an incredible ability to find my derriere until I got back on the right path. So long as I stayed on the path, my life seemed to have harmony and direction; off the path, it was chaotic and dischordant. The chaos-discordant phenomena dominated the period immediately following my suspension from the practice of law, a time which was extremely painful for me. The sole, one and only, true social aspect of my life during that time was visitation with my children. From my perspective, pitifully too few visitations. I drank more than any other time during my life. In one of the frequent moments which, in hindsight, was nothing more than feeling sorry for myself, I realized that the suspension was nothing more than the confrontation with the establishment which I had known all along was inevitable. Rather than seeing it for the opportunity it really was, I had gone into a "poor me" mode and as a result, in reality, had actually wasted a lot of time. Once I simply accepted it as the burden I had been given to bear and hunkered down and got on with it, the change in my life was miraculous. Once again, my life had direction and harmony. More direction and harmony than ever before. This orders of magnitude improvement has occurred on at least two other occasions of a similar nature, but far and away the single greatest occurred January 25, 1999 with the start of the hunger-strike.

Without question, the single greatest fear I have had, to the point of being virtually the only true fear, is that I would not be up to the task. Many times I have felt I'm just not up to this or that at this point in time. This resulted in a huge guilt trip when the economy of the country went into the toilet a decade or so ago. It looked like those "this's and that's" which I hadn't been ready for had squandered the only time when what needed to be done could be done. We are strong again. We have a second chance. Actually, more correctly, I have a second chance. You have your first chance. I shall be eternally grateful for that second chance. You may not want to squander your first chance.

Response to the signage and handout activity has been vastly more successful than I had ever imagined it would be, and I believe it is a 100% certainty it could ultimately be successful. For this effort to be successful, the response must reach a critical mass.

It is a race against time.

However, I have never wanted, nor do I now want, this to be an emotionally driven issue.

I do want it to be a reason driven issue.

There is a difference between appealing to emotion, and noting the urgency of a matter.

The poor do not have access to government.

The politically incorrect do not have access to government.

The elite have access to government. We know elitism is fascism.

We also know relief has been wrongfully withheld in the instant matter for more than twenty years and that continued denial of relief shall certainly kill the victim. The hunger strike merely accelerates that which is otherwise inevitable.

This is a race against time.

There is a difference between appealing to emotion, and noting the urgency of a matter.

Your voice is needed loud, often, and immediately.

Remember the save a penny the first day, and then double the amount each day thereafter forumula? Calling/writing/emailing/faxing daily yourself and recruiting two others to do the same would guarantee a critical mass, wouldn't it.

NOTE: A CAVEAT HAS BEEN ADDED TO YESTERDAY'S REWARD

One of the more common questions asked is "Why don't I just go see a psychiatrist, and give "them" the one thing required for reinstatement?" (... provide substantial evidence ... overcome ... psychiatric problems), even though the court had expressly stated it was not qualified "to arrive at a diagnosis or prognosis", and that there had been no "medical testimony" - nor was there any other evidence.

It is a curious question, but nonetheless one of the more frequent ones.

1. As a matter of principle, it should never, ever be done.

a.) The principle that one is innocent until proven guilty is as important a principle as there is in this society;

b.) were I to meekly comply it could even create the appearance of nefarious collusion, suggesting I desired to create the illusion of having an excuse for some greater wrong;

c.) we all have a duty to make personal sacrifices to preserve uncorrupted that which is sacred, that which is cardinal, and conversely to vigorously attack that which corrupts the sacred and cardinal, to expose and destroy flagrant, constitutionally contemptous abuses of power; and,

d.) to do so would be an act of cowardice.


2. It is an impossibility. The "one thing" is so generically and thus vaguely stated that as a practical matter, the BEST CASE scenario is that even by spending a small fortune, there would be no reasonable assurance whatsoever of resolving the problem. What is the problem? Specifying the problem with specificity is the court's responsibility.

3. It would be stupid for me to do that which I would NOT advise a client to do. Think about it. The court's decision is based ENTIRELY on a subjective judgment. They insist on a subjective judgment from the medical community. And, if they receive the medical community subjective judgment, the court would in turn again make their own subjective judgment. There have been quite enough subjective judgments, sil vou plait.

The court is as elitist as it gets. Is not this issue an icon measure of the degree of judicial elitism!

The medical community is as elitist as it gets. When the facts are presented to you, I am sure you shall agree that this issue is also an icon measure of the degree of medical elitism!

It is time to develop more fully the meaning of elitism.

From the context within which it has been used, it clearly does not mean wealth per se, although many wealthy persons are in fact included in the particular class of elitism as we mean it.

We use elitism in a political sense and in the sense of being arbitrarily privileged, a privilege based on other than merit. The acquisition of wealth can be based on merit; historically, it frequently has not, ala the term robber barons.

The privilege we have referred to almost exclusively is that of "ACCESS" to government, and our complaint is really not that they have access, but rather that in reality they have it exclusively.

While virtually all wealthy people have access to government, not all avail themselves of that access; others use their access judiciously and charitably.

Elitism does not mean wealth per se in another sense. It includes classes which include many, even a majority, who very decidedly are not wealthy. Special interest groups they are called. They enjoy their arbitrary privileges because ELECTED politicians act not on the merit of matters, but rather on that which ensures their political survival.

We are technically a "Constitutional Democratic Republic". Many think of democracy as majority rule government, admittedly vastly superior to our standard of comparison syphilitic tyrant king, but not at all what our forefathers envisioned. Theoretically, it is vastly better than majority rule because in theory even minorities are equal and receive justice for all.

Until recently, historically, minorities have been minorities. Now, however, they are very significantly arbitrarily privileged because of their significance to the political survival of the elective process political system. Obviously, this Message is not designed to generate maximum political support, perhaps an unwise thing to do at this point in this activity, but to do otherwise would risk compromising the activity, the greater of the two evils.

The last two paragraphs of yesterday's Daily Message, the Sunday May 9th message, make the assertion that special interest groups inherently are arbitrarily privileged because of the need for survival of the political system.

It was specifically acknowledged that it was "politically unwise" to make those statements.

Political experts would tell you that the result of the above statements, without more, is to compound the original error. There shall be nothing further on that subject today.

Today, another subject shall be started and left unfinished.

The scientific method is a universally accepted problem solving methodology.

A key step in the method is definition of the problem. One can even argue that once the problem is truly defined, the problem is, in essence, solved.

This Daily Message is addressed to ALL of those on the various Daily Message distribution lists who have a direct responsibility to grant the PonyTail relief, including but not limited to, Janet Reno; Robert Rubin; certain individuals of the Executive Branch of Government hierarchy from as low as the Chief of Staff's office on up, including individuals now retired or otherwise not presently a member of that hierarchy; certain members of the Department of Commerce from as low as the Commissioner of Patent and Trademarks on up, including individuals now retired or otherwise not presently a member of that hierarchy; all judges who joined in the so-called opinion of the supreme court of the state of minnesota by which I was UNLAWFULLY suspended from the practice of law; all members of the supreme court of the state of minnesota disciplinary organization who actively participated in the proceedings by which I was unlawfully suspended from the practice of law, including Warren Satre:

WHEREAS you have conspired to variously unlawfully suspend me from the practices of general law in the state of minnesota and patent law throughout the United States of America and to withhold the services of your offices in order to maintain that unlawful suspension in full force and effect;

WHEREAS the basic fundamental premise of the unlawful suspension is a fictitious, fabricated and concocted designer illness both peculiarly amenable to depriving me of the essential elements of life and otherwise totally inappropriate which has been operating to continually and constantly erode my life forces for not less than twenty years;

WHEREAS there has been a significant decline of my health over approximately the last ten years which has prompted me to contact various ones of you on numerous occasions to seek redress of my grievances which were specifically described in many of those instances as life-threatening conditions;

WHEREAS you have uniformly displayed, at a minimum, a cold, heartless, and reckless disregard for my life manifested by non feasance and malfeasance including overt attempts on my life; and,

WHEREAS you have uniformly displayed an indifference of, and contemptuous disregard for, the Constitution of the United States of America;

NOW, THEREFORE: it is self evident that a state of anarchy exists in the United States of America and by the inherent power vested in each and every citizen of the United States incident to exercising that most fundamental and basic instinctive right of self preservation, you and each of you are hereby formally charged with engaging in a conspiracy to commit murder.

Notwithstanding the foregoing, if before 12:00 midnight Thursday May 13th., 1999, any one of you offers to provide that which is commonly referred to as "state's evidence" deemed sufficient to conclusively implicate at least two persons in the aforesaid conspiracy, including individuals not specifically named or referred to above, I shall agree to request immunity for you from the appropriate prosecuting authority.

FRATRICIDE: one that murders or kills his own brother or sister

Is not a society in which the bureaucracy murders or kills its own citizens a fratricidal society? And the evidence is overwhelming that the peculiarly unlawful suspension of the PonyTail is inconsistent with any legitimate legal purpose but highly effective as an agent for depriving the PonyTail of all means of securing that essential for survival. Fratricidally so. We are not talking abstract theory, are we!

But members of the society not engaged in controversial, confrontational activities don't have to worry, do they. The bureaucracy uses "smart bomb", surgical attacks so only those who "deserve" to be killed are at risk, don't they.

Naive you are if you think that.

Without reservation, qualification, or condition, the bureaucracy put virtually all citizens at risk in this very case, the PonyTail case.

To illustrate, simply note that the plain unvarnished facts of this case are that the PonyTail is the victim and the bureaucrats are the perpetrators, the PonyTail the good guy, and the bureaucrats the bad guys. They sought to reverse that. In doing so, they made it unequivocally clear that they don't give a damn about the rest of you. The only thing they care about is their own selfish agenda.

How have they tried to switch the PonyTail from being the good guy to the bad guy? By trying to provoke him to violence. Without reservation, qualification or condition, they have tried to provoke the PonyTail to violence. As God is my witness, and as one who may shortly meet his maker, I swear they have tried to provoke me to violence. There have been countless incidents of provocation. Patterns of provocation which evince a plan to exploit moments of greatest vulnerability. The second I resorted to violence, the PonyTail issue would cease to exist, the only issue would be the violence issue. But at what price to whom?

It is virtually impossible for me to wreak violence upon the perpetrators.

As God is my witness, and as one ...

The first 103 days of the hunger strike resulted in a 40 pound weight loss, 24% of the original bodyweight (164 pounds) on January 25th., the start of the hunger strike.

Each pound of loss is equal to three thousand five hundred (3500) calories, or a total caloric shortfall of 40 X 3500 = 140,000 calories less than that required to exactly maintain the original bodyweight. Over a period of 103 days that is a one thousand three hundred fifty nine (1359) calorie/day shortfall, roughly a 1400 calorie/day shortfall.

Increasingly management of time, energy and resources becomes more critical. Stated another way, prioritization is increasingly critical.

Today's Daily Message sets forth the four things which I believe would most likely bring the hunger strike to a favorable conclusion. It is from a message posted for someone who expressed a desire to help.

The four things which I believe are most likely to provide immediate relief are:

1) the simple four word declaratory sentence: 'The suspension is unlawful.' from an authoritative legal source such as a well credentialled law professor or a highly credentialled Sr partner of a law firm;

2) convincing Secretary of Treasury Rubin he has some unfinished "old business" which should be cleared up before he leaves office;

3) convincing Deputy Secretary of Treasury Lawrence Summers that Secretary of Treasury Rubin has some unfinished "old business" which should be cleared up before he leaves office; and,

4) getting the issue literally in the hands of minnesota governor Jessee Ventura.


This is not to say your support and assistance of any kind will not be welcome, nor that you might have means to secure immediate relief superior to these four.

Does not this issue directly attack two political myths of this society:

1) that our elected officials are "public servants"; (deal with them directly on an issue which is not "politically correct" (PC for our international readership), and they certainly give a very good impression of being ruling royalty; and,

2) that our elected officials are willing to deliver, other than selectively for propaganda purposes, anything close to the ideals used to urge our armed forces to put their lives on the line and, indeed, used to urge our law enforcement personnel to put their lives on the line on an every day basis.


Does this issue seek utopia or something more like the bare minimum to which any citizen is entitled, even an "politically incorrect" (PI) citizen? (Also PO citizen!)

Remember, the basis for the suspension was actually withdrawn from issue. And, does not the self-contradictory, within the space of a few sentences, yea verily and forsooth, even within the zero space of two consecutive sentences, "unlawful on its face" so-called opinion smack more of disdainful taunting elitist than a scrupulous, attention to detail, faithful servant. And, that act has been "endorsed" by how many? And, for how long?

Would not driving the response to this issue to "critical mass" send a message to our truculent bureaucrats, both elected and career, would it not send them a message which this society dearly needs them to receive?

Remember the act yourself and recruit two others to do the same critical mass formula of earlier messages?

Well folks, another big weekend!

And, the Daily Message Que is overflowing. One day last week produced 6 notes on the back of the layout proofs for the sign. Sunday was one of those days when I could hardly get through my shower without interrupting the chain of thoughts for a Daily Message, and two were outlined and added to the que before leaving for the mall.

So, which one gets the nod for today's Daily Message?

None of those. After I got to the site on Sunday, it seemed as though I was just swarmed with people willing to engage in meaningful exchanges, I had one during the basic process of setup, and a second while dotting the i's and crossing the t's of setup. Not much more than an hour into the activity, an exchange with two "international" men revealed they were Portuguese. An exchange earlier in the week with another international personage had suggested my view of fascism, the USA view was not necessarily the international view, that some in the international community, and indeed significant numbers in the case of Spain specifically (but the person relating this was not from Spain), feel fascism, although flawed, is less flawed than the democratic process. In response to my question, the men acknowledged Portugal was once fascist and I am quite sure they understood the question was not in any way accusative but rather from a perspective of my trying to elicit the international view of fascism. One of the Portuguese men felt quite strongly that fascism was evil, and that the people of Spain also felt that way contrary to what I had been told earlier in the week.

So much for trying to resolve the issue of the international view of fascism.

I do want to state for the benefit of the international recipients of the Daily Message the American View, but first the context:

During WWII, approximately 671,000 American servicemen were wounded and 292,000 were killed.

Our population of course was much smaller then than today, and compared to any other conflict we had previously been engaged in those numbers were huge numbers. Our society felt it had suffered grievously and sustained a monumental loss to put an end to fascism once and for all.

We almost to a person felt they were suffered and given as a final resolution of the fascism issue, that fascism was indeed very evil.

You all no doubt will immediately empathize with my shock and dismay upon accepting the reality that we ourselves had an not insignificant element of fascism in our own society.

And, you will similarly understand the not inconsiderable element of denial which makes it so difficult for Americans who have not experienced what I have experienced to accept that such a degree of fascism does exist in our society.

This topic was selected because it is so hugely important. I full well know it may slow the momentum of resolving the unlawful suspension issue. It has been one of those scenarious with a little nagging voice saying, don't do it, don't do it, and another saying there is no choice in the matter you have to do it. The late distribution is not because it wasn't ready earlier in the day. The basic piece was finished at about 1:15 a.m. this morning. Another hour of editing was done at about 7:30 this morning. It was put aside til now, about 7:00 p.m. to make absolutely sure I could always be comfortable with my decision. I know I shall.

Americans, we can not take the chance that WWII will ever become a fuss between their fascists and our fascists. This is the least we owe to those who gave that last full measure, and those put in harms way regardless of whether they are included in the numbers quoted above. It would be profane beyond expression to let that happen.

One last time, once and for all:

It is equally apparent that he suffers from severe emotional instability which seriously impairs his professional judgment. Without the benefit of competent medical testimony neither the referee nor this court is qualified to arrive at a diagnosis or prognosis concerning the respondent's [PonyTails's] mental health. ... suspended ... petition for reinstatement ... entertained ... provide substantial evidence ... overcome ... psychiatric problems.

That bunch of gibberish has absolutely nothing to do with the law.

It has everything to do with saying the PonyTail is not a member of the club.

It is the epitome of elitism.

We know elitism, as we have defined it in earlier Daily Messages, is fascism.

That elitism must be repudiated. Unequivocally repudiated.

Remember from the previous Saturday Daily Message, "And, that act has been 'endorsed' by how many? And, for how long?" It is not an isolated aberration. Remember that the suspensions occurred in 1978 and 1979.

Another facet of the exchange with the two Portuguese men was a sense that my shock and dismay at finding elements of fascism existed in our society gave them a significant degree of relief, as it similarly has quite a few other international persons. They seem to react as though it symbolizes American's coming down off their high horse (American slang meaning much the same as being "holier than thou", which I trust has international meaning, meaning basically sanctimonious). Another way to express it is a sense that they have felt stigmatized as being from a country which had embraced fascism, a people which were a total aberration. They seemed to feel its existence in the USA proved it was a seductive siren to which all people were vulnerable, even those in a nation which unabashedly, and to them it would seem, ad nauseam, represents itself as the nation of equal rights and justice for all, the nation within which democracy imperviously reigns supreme.

It seems imperative to expressly state that this is in no way a qualification of the earlier statement about what Americans thought we were fighting for in WWII. The final resolution of fascism of the collective mentality stated above is expressly reaffirmed.

The collective white civilian conscious at that time absolutely did not consider our racism even remotely associated with fascism. This notwithstanding our armed services were segregated during WWII. The armed services were not integrated until after WWII, by Harry S. Truman.

I was very young at the time, but these views are not the views of a person of those tender years. Admittedly, the views were essentially formed then; the passage of time has consistently reinforced them.

None of the foregoing is to say military personnel were unaware of the contradictions. My impression is that military personnel almost universally felt the contradictions were of too low a priority to be given consideration during the war. It was that basic, fundamental survival thing. After the war, for the most part they just got lost in the shuffle.

The apparent contradictions, and it just struck me that they are actually not so greatly different from the contradictions of the unlawful suspensions. Those apparent contradictions of the collective being are the same as those of the individual who has not refined his personal philosophy. As such, they are not wilful contradictions but rather those of human imperfection.

It is this distinction which those of the international community seem to want us to acknowledge.

I believe we owe them that much.

This is not to in anyway diminish our unqualified repudiation of the horrors of WWII fascism.

It is to expressly recognize what happens when the individual conscience passively submits to the collective mind. It is an attempt to sensitive the citizenry of this country to how fragile our rights and freedoms are. My area of expertise is not that of "the collective mind", but I understand it is of the genre of gang and mob behavior.

Is it not exactly and precisely what the sentiments expressed by Thomas Jefferson of yesterday's Daily Message warned us to guard against? Thomas Jefferson's admonition of a need for "eternal vigilance" certainly was not overstated.

The unlawful suspensions are wilful and malicious. Is this not exactly and precisely why the unlawful suspensions have to be repudiated?

Unequivocally repudiated!

Americans, those of you who feel real pain to discover this society now harbors and nurtures the very evil it sacrificed so much to eradicate, I grieve with you.

To those americans who foster and create this evil for their own selfish interests, I would condemn you to hell for all eternity!!!

If you in fact are aware of my attempts to get you to make the minnesota incumbents settle the issue before you took office, are you so sure now that would not have been a good idea?

All you would have had to have done was tell them to settle the matter or you would, pre-inauguration, call a press conference, tell the media that minnesota had done a grievous wrong long before you were elected, and that you would not be a party to that wrong. You and your term of office would have been free of the onus of this matter.

I don't have time to double check now but I'm sure I also mentioned that: 1) statutes of limitations certainly shall be tolled in this particular case; and, 2) that statutes of limitations do not even start to run in on-going matters.

Generally, the definition of fascism as elitism is at least well if not very well received.

It is an effective mechanism for communicating that "they" are not what they are supposed to be.

It is an effective mechanism for communicating that "they" bring dishonor to this society.

It is an effective mechanism for communicating that "they" betray those who gave that last full measure.

They who are in control.

A very meaningful exchange with a WWII veteran at the 20th and Constitution site last week inspired this Daily Message. He saw Communists as the likely bad guys; there can be no doubt about my views re the threat of fascists.

Our conversation encompassed vastly more than that issue, but later as I thought about it, my mind focused on how our conversation had explored what they are much more than what they are not. I realized that while we differed as to what they are, and although we spent little time actually talking about it, we were in total agreement as to what they were not.

They are not those who bring honor and respect to this society.

They are not those who zealously guard, preserve and protect that for which so many have given that last full measure.

They who are in control.

Perpetrators, collaborators and facilitators (PCFs) take heed.

The lead story last night on virtually every news broadcast was the death of the Florida woman who won court approval to discontinue her life support system after having her spinal cord severed by a shot fired by her mother.

Florida prosecutors reportedly are going to prosecute the mother for murder.

PCFs, the Florida case is the PonyTail issue without the aggravating circumstances of the perpetrator having an opportunity, and obstinately, trucculently refusing to mitigate the injury. Indeed PCFs, you have arrogantly exacerbated rather than mitigated the injury. At this very minute you could mitigate the injury with a simple, four word declaratory sentence: "THE SUSPENSIONS ARE UNLAWFUL."

On Sunday at the 20th and Constitution site, a person argued that if I died, "they would win". My response: if I die, for the rest of their lives they shall be only one honest person away from serving hard time for murder one, the charge shall simply go from conspiracy to commit murder to murder one.

PCFs, take heed. It is not too late for you yet. Today is the 116th. day of the hunger strike. How much time do you think you have? PCFs, take heed.

Another tragedy.

There is too little information about the most recent for one to be able to comment intelligently about it other than to note that there are still far too many experts who fail to address the CAUSE of the problem.

Do not all of these tragedies include the following three causal factors:

a) alienation;

b) ready access to means for large scale violence; and,

c) lack of a deterrent for using violence?


My personal feeling is that the genie is out of the bottle re the access issue. We are a gun society, and shall remain one for quite some time it would seem. This is not taking sides on this issue, but merely a comment on how to most productively spend our time, energy, and resources in combatting this problem.

Is it therefore not more likely that the solution to this problem lies in correcting the alienation and lack of a deterrent issues? Let's examine the latter briefly.

Why is it our youth almost casually turn to violence as a solution for their problems?

Are the problems of our youth today actually that much greater than were our problems during that phase of our lives?

What deterred us from using violence in virtually the same exact scenarios?

Does this not eventually get down to the value system of the society?

And, are not we adults the ones responsible for the value system as it exists today?

Let's let this thought process, like new wine, mature for awhile.

Our May 21st Daily Message offered for your consideration three specific causal factors (alienation, ready access to means for large scale violence, and lack of a deterrent for using violence) for the series of school-centric tragedies which this society has experienced over the last few years and posed the question of whether the true causal factor was not the value system of this society, a value system produced by the adults of the society.

It had been my intention to complete and distribute this Saturday evening as the Sunday Daily Message to make it as much an ecumenical message as possible but yesterday was sort of a reverse two-fer* and I was too exhausted last night to do that. It is done in that spirit today.

Again, this is not my area of specialty but I would like to offer a few thoughts in essentially laymen's terms which the experts can then either refute or translate into more precise terms as the case may be. This is another of those "too important not to" matters.

Concerning the first causal factor, much of the emphasis has been put on the alienation between the various factions; for example, the jocks and those who were especially religious.

Isn't the more significant alienation an alienation from the society per se?

And similarly, lack of deterrent does not mean lack of metal detectors, nor lack of monitors, etc., etc., but rather deterrent in the larger sense of moral restraint.

Does not this lack of restraint also evince an alienation from the society per se?

Again, let us let this thought process mature for awile.

* for the International readership, slang derived from the loss-leader marketing practice of offering two items for the price of one; two-fer thus means anything which has a double benefit; and a reverse two-fer - yesterday I had a double agenda.

The Sunday Daily message made the case that the third causal factor, lack of deterrence, was in fact a species of alienation.

It also took the position that in placing the blame, we adults need look no further than ourselves, we are the ones responsible for the value system of this society.

I thought that an early Daily Message had included a reference to a discourse on juvenile delinquency which occurred in the 70's but a search of the database for "juvenile" came up empty handed.

In any event, as a breakfast club program chairman circa the 70's, I scheduled a PhD (I believe her first name was Gisella and I can not for the life of me remember her last name) who was at least locally (minnesota) recognized as an authority on juvenile delinquency. In our discussions she had confirmed that a major causal factor of juvenile delinquency was the dual standard of adults, the say one thing, but do another hypocrisy of adults.

We have no further to look than ourselves for the problem.

And, forget the grandiose solutions.

Look no further than the Mission Statement of the PonyTail Institue for Change:

We started out as loyal subjects of the King, but after awhile we said enough of this already; threw a few crates of tea into the harbor; killed a few of them; got a few of ours killed; got a few mercenaries killed; got ourselves polarized, irreconcilably polarized in not a few instances I understand; got a few other countries who weren't all that hot about the King on our side; and, got ourselves a brand spanking new Constitution.

Made quite a fuss over that Constitution. Had one fellow say give me liberty or give me death. Have never heard anyone suggest he was saying anything other than the literal truth when he said it. Believe another fellow involved in the early stages of that Consitutional process thing say after they'd all literally signed on the dotted line to get rid of the King that they'd all better hang together, or they'd surely all hang alone. Pretty serious business it would seem.

Did anyone else pick up on the recent current administration mantra of "we must all hang together"? With all their media experience and skills it seemed inappropriate for the particular context within which the multiple source, simultaneous utterances were made. Somehow or other I associated it more with the "solid blue line" phenomena. When all the subtleties of the context within which the multiple source, simultaneous utterances were factored in, it definitely seemed like a calculated appeal to fear.

Was not the former use of the phrase more an appeal to reason than an appeal to fear? Was it not made to emphasize the strength of their convictions?

Subtle, but real distinctions!

And I have said numerous times I did not want the PonyTail Issue to be emotionally driven, but rather reason driven.

Is there not a difference between the emotions of fear and greed and a passion for liberty, due process, justice for all, basically a passion for our Constitutional rights? Is not this passion based on the reason that so many have put their lives on the line for the strength of their convictions.

Subtle, but real distinctions and yet at the same time so vastly different we readily recognize them as differences in kind rather than differences in degree.

On Monday, one exchange in particular seemed as though it were backsliding, it dwelt for some time on an issue which hadn't been raised in a long time.

Of course, every individual totally unaware of the issue is no different from the very first individual with whom I discussed the matter, but for some reason or other the "VOID" issue had not come up in a very long time, and the individual on Monday was persistent about pursuing the matter.

Whether the individual was in denial or was "one of them" desperately looking for some basis for justifying stonewalling by the attorney general I do not know.

I do know that void simply did not mean void to the individual.

The so-called decision which purports to suspend me from the practice of law is void. The so-called decision is unlawful "on its face".

Webster defines void as: "of no legal force or effect".

The concluding paragraph of a paper titled "VOID JUDICIAL DECISIONS" which I have routinely distributed to legal types, including the attorney general, follows:

A decision invalid on its face is void, a nullity, and is open to attack or impeachment in any proceeding, direct or collateral, Riley, supra at 366, Carpenter v Carpenter, 93 SE2nd 617, 622, 244 NC 286, and at any time, Carpenter, supra. at 622, Simonds v Norwich, (C.C.A. 8) 73 F2d 412, 415. Indeed, a tribunal is precluded from recognizing a void order of a state court as valid, In re Noell, supra. at 6, Selling v Radford, 37 S Ct 377, 379, 243 US 46, 51.

Of course the names of all cases are underlined in the original and the cites for Riley and Noell are "Riley v Pearson, 139 NW 361, 366, 120 Minn 210" and "In re Noell, 93 F2d 5, 6". The entire paper is available as an email attachment upon request.

Do you not agree that a systematic, methodical and calculated subversion of the Constitution, by any official sworn by oath to uphold the Constitution, would be impeachable conduct?

Do you not agree that if someone responsible for the impeachment process: a) was aware of the possible existence of such conduct; and, b) failed to ascertain whether or not it in fact existed, that such party joined in the behavior and thereby created a conspiracy to subvert the Constitution?

Do you not agree that if significant numbers of the general population are aware of the conduct, yet do nothing, they thereby embrace the conduct?

Do you not agree that if the foregoing is true, that any such society has no constitution?

Such a society has only anarchy.

A few days ago the Daily Message included the statement:

Forgive me if from my perspective it seems that it [the Constitution] does not seem at this point in time to be taken with the same degree of gravity [as when it was created, if it seems as] if the society doesn't have the same degree of passion for it.

Species homo sapien really does seem prone to learn things the hard way.

My parents experienced the stock market crash of '29, the great depression which followed the crash, and the horrendous drought, known as the dirty thirties, which was part of that same time frame. We children seemed immensely ungrateful at times to them and their friends who had endured the same hardships, and I particularly recall an especially close friend of the family once remarking "what this country really needs is another depression".

Species homo sapien really does seem prone to learn things the hard way.

Those of my generation experienced WWII during the formative years of our lives. Literally our first memories included the sacrifices incident to the war, the rationing stamp books, collecting tin foil from gum wrappers, and the silk from milk weed plants are still vivid memories for me. Virtually all of us have memories of loved ones killed or wounded during that conflict. All of us knew many who served in that conflict, and know how passionately they felt about what they thought they had been fighting against and for, a passion not unlike that of those who laid their lives on the line for the Constitution.

I can not bring myself to say that what this country really needs ..., but species homo sapien really does seem prone to learn things the hard way.

It seems 100% of us have difficulty understanding something we have not experienced ourselves.

Worse still is how we apparently can forget something about which we once felt so passionately.

For me at least, it is foolish to try to improve on the words Lincoln chose to honor those who gave their lives on behalf of their country.

"That last full measure" says it all for me.

Whatever the words, however, they remain merely words unless our actions, individually and collectively as a society, are consistent with them.

The fight is irrevocably over for those who gave that last full measure.

The fight cannot be over for the rest of us until this society delivers that for which they thought they were fighting. Otherwise, the words, whatever they may be, are merely words.

Today, as I have done every memorial day since coming to this area in the mid 80's, I shall go to the Vietnam Memorial to pay my respects to the son of my first grade teacher.

As I have done for the past few years, I shall leave the memorial area before the start of the official ceremonies, a ceremony of merely words as I know all too well. They deserve better. They deserve to be truly honored.
